These Terms & Conditions ("Terms") are a binding agreement between you and Temperature Control Services, Inc., a North Carolina corporation ("we," "us," "our"). They govern your use of tempcontrolservice.com, our online booking and forms, our phone, email, and text-message communications, and the HVAC services we provide.

By accessing this website, requesting service, or scheduling work with us, you agree to these Terms. If you do not agree, do not use the website or request service. These Terms incorporate our Privacy Policy by reference, including the Your Privacy Choices section and its opt-out instructions.

You must be at least 18 years old and able to form a binding contract under North Carolina law to use the site or request service.

Temperature Control Services, Inc. provides residential and light-commercial heating, ventilation, and air-conditioning ("HVAC") services — including AC, heating, heat-pump, ductless mini-split, and gas-line work — within our published service areas in North Carolina. Service availability, scheduling, equipment selection, and final pricing are subject to confirmation at the time of booking and on-site inspection.

• Estimates are non-binding until a signed written agreement (estimate, work order, or invoice) is in place. Pricing shown on the website, in marketing, or in an unsigned quote is illustrative only and may change after an in-person inspection.
• Written estimates are typically valid for 30 days unless stated otherwise. Material, equipment, and labor costs may change without notice.
• Payment is due upon completion of the work unless we have agreed in writing to other terms (such as financing or progress payments).
• Late payments may incur reasonable late fees and interest at the maximum rate permitted by North Carolina law.
• Returned checks, declined cards, and collection costs (including reasonable attorneys' fees where permitted) may be charged back to the customer.
• Financing is offered through independent third-party lenders. Approval, rates, and terms are determined by the lender, not by us, and are governed by the lender's own agreements and disclosures.

You agree to:

• Provide safe, lawful, and unobstructed access to the work site.
• Secure pets and personal belongings.
• Disclose known issues with the property, the HVAC system, electrical, gas, plumbing, or any prior repairs.
• Follow all safety instructions from our technicians.
• Obtain permission of the property owner if you are not the owner.
• Ensure that adequate electrical, gas, drainage, and structural conditions exist for the work requested.

We may suspend or refuse service if these conditions are not met or if the work site is unsafe.

• Manufacturer warranties on equipment we install are provided by the manufacturer and are governed by the manufacturer's terms. We will assist with valid warranty claims; we do not warrant the manufacturer's products ourselves.
• Workmanship warranties on installation labor are stated in the written service or installation agreement provided with your job. Where no written workmanship warranty is provided, our workmanship is warranted for thirty (30) days from completion against defects in workmanship, exclusive of normal wear and tear, abuse, neglect, modifications by others, acts of God, power surges, pre-existing conditions, or items outside the scope of work.
• Warranty service must be requested in writing within the applicable warranty period and is conditioned on full payment of all amounts owed.

Portions of this website — including blog posts, FAQs, service descriptions, on-site chat or estimator tools, and other content — may be generated, edited, or routed by artificial intelligence and automation tools. You represent that you own or have the right to submit the content and that it does not infringe any third-party rights.

AND OUR OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, OR PROPERTY DAMAGE — ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE, ANY CONTENT, OR ANY SERVICES, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE WEBSITE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Liability for negligence in the on-site performance of HVAC services is governed by the separate written service agreement for that job (not this website agreement).

Some jurisdictions do not allow the exclusion or limitation of certain damages; those provisions apply to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless Temperature Control Services, Inc. and our owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) your misuse of the website; (c) your violation of any law or third-party right; or (d) any content you submit. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with our defense.

By providing your phone number and opting in, you agree to receive text messages from Temperature Control Services, Inc. at the number provided, including messages sent by auto-dialer. Consent is not a condition of purchase.

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Subject to the arbitration section below, the exclusive venue for any judicial proceeding permitted under these Terms is the state and federal courts located in Granville County, North Carolina, and you and we consent to the personal jurisdiction of those courts.

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS.

You and Temperature Control Services, Inc. agree that any dispute, claim, or controversy arising out of or relating to these Terms, the website, our communications, or our services (each a "Dispute") — except for small-claims matters within the jurisdictional limit and except for claims for injunctive relief to stop infringement of intellectual-property rights — will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules in effect at the time the arbitration is commenced. The arbitration will be conducted in or near Granville County, North Carolina, or by video conference at the arbitrator's discretion. The arbitrator has exclusive authority to resolve any Dispute, including the scope and enforceability of this arbitration agreement.

Class-action waiver. You and Temperature Control Services, Inc. agree that any Dispute will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate the claims of more than one individual and may not preside over any form of representative proceeding.

30-day opt-out. You may opt out of this arbitration agreement by sending written notice to Temperature Control Services, Inc., 1518 Cash Rd, Creedmoor, NC 27522, or emailing [email protected] within thirty (30) days after first agreeing to these Terms (for example, by submitting a form or requesting service). Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms.

If this arbitration agreement is found unenforceable for any reason, the rest of these Terms remain in effect, and Disputes will be resolved in the courts identified under Governing Law & Venue.

Before filing any arbitration or lawsuit, you agree to give us written notice of the Dispute (including a brief description of the issue and the relief requested) at 1518 Cash Rd, Creedmoor, NC 27522 or [email protected], and to give us a reasonable opportunity (at least thirty (30) days) to resolve the matter informally.

We may suspend or terminate your access to the website at any time, with or without notice, for any reason — including violation of these Terms or to protect the security of the site or other users. Sections of these Terms that by their nature should survive termination (including warranty disclaimers, limitation of liability, indemnification, governing law, and arbitration) will survive.

If any provision of these Terms is held unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right is not a waiver of that right.

These Terms, together with our Privacy Policy and any written service or installation agreement signed for your job, are the entire agreement between you and Temperature Control Services, Inc. regarding the website and our services, and they supersede any prior agreements on the subject. You may not assign these Terms without our written consent; we may assign them to a successor in connection with a merger, acquisition, or sale of assets.

We may update these Terms from time to time. The "Last updated" date reflects when they were last changed. Material changes will be highlighted on the page; your continued use of the site after a change indicates acceptance of the updated Terms.
